  • When did the lease agreement begin, and when is it set to expire?
  • Do you have any documented evidence of the tenant's breaches?
  • Have you issued any formal notices for non-payment of rent or violation of lease terms?

Q1: What can I do if my tenant refuses to leave even after eviction notice?

Your first course of action should be to initiate formal eviction proceedings. If the tenant still refuses, law enforcement can assist in removing the tenant.

Q2: Can I increase the rent during an ongoing lease agreement?

Generally, rent can't be increased during the term of a fixed-term lease unless the lease itself provides for an increase. For month-to-month tenancies, a notice, typically 30 days, is usually required.

Q3: What if my tenant damages the property?

If a tenant causes damages exceeding normal wear and tear, you can deduct repair costs from the security deposit. If damages exceed the deposit, you might need to pursue legal action.

Q4: Can a tenant sue for false accusations or harassment?

Yes, a tenant can sue a landlord for various reasons, including false accusations, harassment, or neglect. It's essential to handle all tenant matters professionally and keep records of all interactions.

Q5: How long do eviction proceedings typically take in Schenectady?

The duration of eviction proceedings can vary. However, with proper documentation and legal representation, most cases can be resolved within a few weeks to a couple of months.
