So, I bought this house in Los Angeles last year. The property is amazing and I love it, but recently I've been having some issues with my neighbor. They built a fence that I believe is on my property. I've talked to them about it, but they are adamant that they are in the right.

What have I done so far?

I hired a surveyor to confirm the property lines, and sure enough, the fence is about two feet onto my property. I have a copy of the survey and have spoken to a lawyer briefly, but I'm not sure what to do next.

What are my legal options?

Here's what I'm thinking:

  • File a complaint with the city's zoning department
  • Take my neighbor to small claims court
  • Try to resolve the issue through mediation

Which of these options is the best, and are there any other legal avenues I should consider?

What's the cost?

I'm also concerned about how much this is going to cost me. I'm not sure if my homeowner's insurance will cover any of the legal fees. Has anyone had any experience with this type of situation?

  • How much did it cost you?
  • Were you able to get any compensation for the costs?
  • Any recommendations for affordable legal help in Los Angeles?

What else should I consider?

I want to make sure I'm making the right decision before proceeding. Are there any other factors I should take into consideration before taking legal action? I don't want to ruin my relationship with my neighbor, but I also don't want to be taken advantage of.

I appreciate any advice you guys can give me. Thanks!

Legal Solution

The response provided below is specific to Real estate attorneys in the jurisdiction of Los Angeles. If the response is inadequate, please submit a detailed inquiry.

Legal Overview of Property Line Dispute

Relevant Statutes and Resources

  • California Civil Code Section 829: Governing property boundary disputes.
  • California Civil Code Section 841: Regarding fences and their maintenance.
  • Los Angeles Municipal Code (LAMC): Specific local regulations regarding zoning and property boundaries. Visit the City of Los Angeles official website for more details.

Possible Solutions

  1. Zoning Department Complaint: You can file a complaint with the city's zoning department, especially if the fence violates local ordinances.
  2. Small Claims Court: If the amount in dispute is below the statutory limit (generally around $10,000 for individuals in California), you might consider pursuing the matter in small claims court.
  3. Mediation: A more amicable solution might be to propose mediation, where a neutral third-party can help you and your neighbor come to an agreement. For local mediators specializing in property disputes, you might want to find the right lawyer.

Cost Estimates

Service Average Cost (LA) % Difference from National Average
Professional Survey $1,200 +15%
Mediation (per session) $500 +20%
Small Claims Court (including filing) $200 +10%

Note: These are average costs; actual prices can vary based on the complexity of the case and the professionals you hire.

Complexity of Property Line Disputes

Property boundary issues can become complicated due to various factors such as historical property records, differing interpretations of those records, or the emotional involvement of the parties.

Case Study 1: In 2018, a Los Angeles resident faced a similar issue where the neighbor built a structure that infringed upon their property. Through mediation, both parties agreed to adjust the boundary line officially.

Case Study 2: Another case in 2017 had neighbors disputing over a tree that straddled their property line. It escalated to court, where it was determined that both parties were responsible for the tree's maintenance.

Case Study 3: A 2019 case involved a family that had been using a piece of land for over 20 years, only to find out it belonged to their neighbor. Based on the doctrine of adverse possession, the family was able to claim rights to the land.

Key Questions for Consideration

  • Historical Agreements: Have there been any previous agreements or discussions regarding the property line with former property owners or the current neighbor?

  • Cost-Benefit Analysis: Will the cost of legal action or mediation be worth the potential benefit of reclaiming the two feet of property?

  • Future Relations: How important is your relationship with your neighbor, and how might this dispute affect that relationship?

Q1: How long does a typical property line dispute take to resolve?

In most cases, if resolved through mediation, disputes can be settled within a few weeks to a few months. However, if the matter goes to court, it can take anywhere from several months to a few years, depending on the complexity and the court's schedule.

Q2: Can I move the fence myself since it's on my property?

It's essential not to take matters into your own hands. Moving the fence without legal authority or an agreement can escalate the dispute and even result in legal penalties against you.

Q3: Will my homeowner's insurance cover the legal fees?

Typically, homeowner's insurance does not cover property boundary disputes. However, it's always best to review your specific policy or consult with your insurance agent.

Q4: What if my neighbor refuses mediation?

If your neighbor declines mediation, you can still explore other avenues, such as filing a complaint with the city or considering legal action through small claims court or superior court.

Q5: Can I claim damages for the time the fence has been on my property?

It's possible, especially if you can demonstrate that the encroachment has caused financial harm. However, such claims can be challenging to prove and might be more suitable for higher court than small claims court. Always compare lawyers in your area to find the best fit for your situation.

A distinct fence separating two properties is visible, with one side having a small section that appears to encroach onto the neighboring property. There are surveying tools like a tripod and measuring tape placed near the fence, suggesting a recent property survey. The overall mood is calm, but there is a subtle tension between the two properties.
