Workplace injuries law in Washington - key changes in 2023
In 2023, Washington's workplace injury laws will be undergoing some key changes. The first change is the introduction of a new civil penalty for employers who fail to comply with the state law pertaining to employee safety. This penalty will be up to $100 per violation and could include up to six months in jail if multiple violations are found. Additionally, the state has expanded its definition of workplace injuries to include mental and emotional distress caused by one's working environment. This means that employers can now be held liable for not only physical, but also psychological harm caused to their employees.
Furthermore, starting in 2023 it will become mandatory for all employers to provide a safe working environment that adheres to state safety standards. Employers must also post a notice to all employees explaining these standards and take reasonable steps to ensure that their workplace is free from hazards. Additionally, employers will be required to provide written documentation of any hazardous condition and measures taken to abate or eliminate them.
