DUI / DWI law in Texas in 2023 - key changes

2023 brings some major changes to DUI / DWI law in Texas. Under new legislation, first-time offenders will face stiffer penalties than before. First time DUIs can now incur fines up to $2,000 and jail sentences of up to 180 days. Further, if the offender is found guilty of a second offense within five years of the original conviction, they are subject to even more severe punishments. Repeat offenses may result in fines as high as $4,000, mandatory alcohol education courses, and license suspensions for up to two years. Ignition interlock devices will also be required for those convicted of multiple DUI/DWI offenses in order to ensure that no further violations occur. The consequences for refusing a breathalyzer test have also been increased, with refusal punishable by fines of up to $2,000 and suspension of one’s driver's license for up to 180 days.


Furthermore, if an accident occurs while under the influence that leads to serious injury or death, additional felony charges may be brought against the offender. These offenses can result in significant prison sentences as well as costly financial penalties.

Ultimately, Texas has stepped up its DUI/DWI law enforcement in order to ensure public safety on its roads. Those convicted of a DUI are urged to seek legal counsel and take all measures necessary to protect their rights.
