I am facing an indictment for allegedly selling a 0.5 g or more to a confidential informant of the Obion County Sheriffs Department in Union City TN. I have not yet been served with said warrant due to serving out a sentence from the general sessions judge of 90 days treatment. The warrant was filed on October 4,2022. The Incident in question was said to have occured on November 04,2021. Due to complying with General sessions sentencing, I did not make Circuit Court arraignment on October 19, 2022. I am assuming that resulted in a bench warrant on top of the indictment. I believe I have a strong case of harrassment against both of some county and city officers....2 in general. I know that the circuit court arraignments are next scheduled for the 4th and 17th of January. 2023. I'd prefer not to have to spend time incarcerated considering I was gone from August 28, 2022 up through December 30, 2022 obeying General Sessions convictions. I am in the low income bracket and currently unemployed and filed for disability due to mental and substance issues. If any additional information is needed please do not hesitate to call me at 731-592-8838. I do not feel as I deserve this charge due to my former use of drugs considering I wasn't a dealer only user. case # 66GS1-2022-CR-1037 and 66CC1-2022-CR-163 in Obion County Tn. I hope to hear from someone soon as I have all intentions to turn myself in either the evening of Jan. 3rd, 2023 (after my job interview for tyson foods in union city) or first thing Jan. 4th, 2023 to hopefully make the docket for going in front of judge parham that morning. no matter How this ends up taking place I do want my motion of discovery from the jump and i want to see video evidence that I was id'd as the selling party. Thank you for taking time to read my situation and I'd be most grateful for a replied answer before I turn myself in.

Thank You,

April

Addressing the Indictment and Legal Considerations in Union City

Immediate Concerns:

Given the gravity of your situation, it's crucial to be fully informed of your rights and potential courses of action. Your challenges span from alleged drug sales to confidential informants, potential procedural violations, harassment allegations, and concerns about bench warrants.

  1. Right to Counsel: Your immediate priority should be to seek representation. If you cannot afford an attorney, the court may appoint a public defender for you. Having competent counsel can ensure that your rights are protected and that you make informed decisions throughout the process.
  2. Bench Warrant: If you believe there might be a bench warrant out for your absence during the Circuit Court arraignment, you should discuss this with your attorney before turning yourself in. A bench warrant can lead to your immediate arrest.
  3. Harassment Allegations: Claims of harassment against law enforcement officials are serious and can significantly impact your case. Documentation, evidence, and witnesses will be crucial in substantiating these claims.

Relevant Legal Provisions:

Given the location and nature of your case, the following would be relevant:

  • Tennessee Code Title 39. Criminal Offenses § 39-17-417: This provision deals with the manufacture, delivery, sale, or possession of methamphetamine.
  • Tennessee Rules of Criminal Procedure - Rule 12.1: Discusses notice of an alibi defense.
  • Tennessee Code Title 40. Criminal Procedure § 40-30-303: Regarding post-conviction procedure and grounds for relief.

For more specifics, visit the Tennessee State Government's website.

Potential Course of Action:

  1. Seek Representation: Before turning yourself in, consult with a criminal defense lawyer in Union City. They can guide you on the best way to handle the bench warrant and the indictment.
  2. Arraignment: If your assumption is correct about missing a Circuit Court arraignment, you might have an additional legal hurdle. Your lawyer can argue on your behalf regarding the circumstances of your absence.
  3. Discovery Motion: You mentioned wanting a motion of discovery and to see video evidence. Discovery is a crucial phase in criminal proceedings. Your lawyer can ensure that all evidence against you is provided and can challenge any inconsistencies or illegalities.
  4. Challenge the Allegations: Given your claims of only being a user and not a dealer, your lawyer can challenge the prosecution's evidence and narrative. This can significantly affect the outcome of your case.

Financial Considerations:

Given your current financial circumstances, you may qualify for a court-appointed attorney. However, if you're considering private representation, costs vary based on:

  • Attorney Experience: More experienced attorneys might charge higher rates.
  • Complexity of the Case: If your case involves multiple charges, extensive evidence, or expert witnesses, costs can rise.
  • Case Duration: A case that goes to trial will typically cost more than one that is settled out of court.

Engage and Act:

While your situation is undoubtedly challenging, you're taking the right step by seeking guidance and intending to confront the charges. Make sure to prioritize legal counsel above all else.

Relevant Questions:

  1. Have you ever been represented by a public defender in Union City before?
  2. Can you detail any specific instances of harassment you've experienced from the county or city officers?
  3. Are there any witnesses or evidence that can corroborate your claims of being solely a drug user and not a dealer?

Q1: What are my rights if I believe I've been wrongfully indicted?

An indictment is a formal accusation, not a conviction. You have the right to challenge it in court, present evidence, call witnesses, and be represented by an attorney. If you cannot afford an attorney, one will be provided for you.

Q2: How can I challenge a bench warrant in Union City?

It's essential to consult with an attorney. They might be able to file a motion to quash or recall the bench warrant, especially if there's a valid reason for missing the court appearance.

Q3: What can I do if I believe I'm a victim of police harassment?

Allegations of police harassment are serious. You should document every incident, gather any evidence or witnesses, and consult with an attorney. Depending on the specifics, you may have grounds for a civil lawsuit or a defense in a criminal case.

Q4: What's the significance of a motion of discovery in my case?

A motion of discovery compels the prosecution to share all evidence they intend to use against you. It ensures transparency and gives your defense a chance to review and potentially challenge the evidence.

Q5: How can I afford legal representation if I'm currently unemployed and facing financial hardships?

You might qualify for a court-appointed attorney if you cannot afford private counsel. Alternatively, some attorneys work on a sliding scale based on income, or there might be legal aid services available in your area.

Remember, facing criminal charges is serious, and the decisions you make can have long-lasting consequences. Always prioritize legal counsel and ensure you understand each step of the process. Consider taking a moment to compare lawyers in your area to find the best fit for your situation.

A criminal defense lawyer is a lawyer (mostly barristers) specializing in the defense of individuals and companies charged with criminal activity. Some criminal defense lawyers are privately retained, while others are employed by the various jurisdictions with criminal courts for appointment to represent indigent persons; the latter are generally called public defenders. The terminology is imprecise because each jurisdiction may have different practices with various levels of input from state and federal law or consent decrees. Some jurisdictions use a rotating system of appointments with judges appointing a private practice attorney or firm for each case. Source: https://en.wikipedia.org/wiki/Criminal_defense_lawyer
