While I was sitting in traffic waiting for a red light to change, a truck owned by a road construction company rear ended my car twice! The driver of the truck did not use the floor mounted gear shift correctly. My insurance company has determined that the other driver was 100 percent at fault and it now pursuing the construction company for reimbursement of the monies that were paid out to me. My insurance company has reimbursed me $4,000 for the total loss of my car. Can I pursue the trucking company that the other driver works for to recover money for the total loss of my car? As my long time mechanics can tell you, my car was in excellent mechanical shape but because it was older, I did not receive enough of a reimbursement from my insurance company to purchase a comparable used car to replace it. I am left feeling like my car has been stolen from me.
