If you return a previously bought vehicle within 24 hrs, and the salesman tell you, "YOU CANNOT" cancel with that 24 hr. and I believed him and kept the vehicle can I sue for the balance of the loan I took out? and return the car months later??

I financed a truck, the check engine light came on later that day, the next morning I returned the truck, I wanted to cancel and purchase another truck at same dealership without a check engine light on, ( within 24 hours) salesman says in his own words: It's to late I cant cancel (turns out to be a lie) he and his lawyers says dmv law says once I sign the agreement I own it, also a written agreement to relace running boards and part of purchase agreement, then changed words to repair on docs. but running boards are un repairable, so refused to relaced running boards. and fix check engine light.  im talking them to small claims court, (to  fix catalytic converter and running boards) should I have taken them to another court?  what the significance of him lying to me that I could not cancel the purchase that was clearly within the24 hrs, because I would have returned it if I could have. could I sue to return the truck? or pay the remaining balance of the loan I took out?

Consumer Vehicle Returns and Misrepresentations in Virginia

When buying a vehicle, the last thing any consumer expects is to discover mechanical issues or misleading sales tactics immediately after the purchase. Especially within a 24-hour period, the trust between a consumer and a dealership can be severely affected.

Virginia's Relevant Laws

To navigate this, it's essential to be familiar with Virginia's consumer protection and vehicle purchase laws. While I'm unable to directly link specific sections of the Virginia code, you can consult the following resources:

Addressing the Issue

  1. Misrepresentation: If the salesman made a false claim that you couldn't return the vehicle within 24 hours, this could be considered deceptive business practices. In Virginia, consumers may have rights to address misleading or false statements made during a transaction.

  2. Warranty and Repairs: If the dealership promised to replace or repair specific items, like the running boards, and then failed to honor that commitment, it could be a breach of contract. This, combined with the check engine light issue, may further support your claims.

  3. Legal Action: Taking them to small claims court may be appropriate for seeking compensation for repairs. However, if you're considering undoing the entire sale due to deceit or other legal breaches, consulting a larger civil court and a consumer law attorney may be necessary.

Legal Fees and Associated Costs in Virginia

Based on the complexity of your situation, here's an estimated breakdown of potential legal fees:

Legal Service Average Cost in Virginia
Consultation with Consumer Law Attorney $250 - $500
Small Claims Court Representation $500 - $1,500
Civil Court Representation for Deception $2,000 - $10,000
Expert Witness (Mechanical inspection) $300 - $800

Please note that these figures are rough estimates and can vary based on the attorney's experience, the complexity of the case, and other factors.

Seeking Clarification and Next Steps

While the information you've provided gives a broad understanding of your situation, clarifying specific details can be essential. Before embarking on any legal journey, it's crucial to have a complete understanding of the facts.

Questions to Consider

  1. Purchase Agreement: Did the purchase agreement explicitly state the dealership's obligations regarding repairs and replacements?
  2. Deceptive Practices: Besides the 24-hour return claim, were there any other misleading statements or actions from the dealership?
  3. Documentation: Do you have any written communication or proof of the claims made by the salesman about the inability to return the vehicle?
