I live in a duplex beside a pond. There are other houses surrounding the pond. However, I’ve been told by the town that based on the town map, most of the pond is on my property so I am responsible for the pond. The pond is not included in the size of my property. If I need to do anything to the pond, I would have to get the town’s permission first. Water from other areas in the town flow into the pond; water flows out of the pond to other areas. The pond provides food and shelter for wildlife. It is not the personal property of a duplex house owner. The pond is desperately in need of cleaning and maintenance. Who is actually responsible for maintaining the pond?
