I'm facing significant debt due to divorce proceedings and uncertain how to proceed.

I'm in a bit of a bind here. My divorce has dragged on and I've been covering some of the costs from my paycheck, but I've also had to resort to an interest-free credit card to the tune of about £12k. I don't get any child support and I'm emotionally and financially drained. I plan to accept his offer for a lower division of assets just so I can move on.

Sadly, I'll have to part with the family home and he wants half of whatever we get from selling it. I can't buy his half, and it's just too large for me alone. Given this, I reckon I'll need a mortgage of about £50k to buy another place. But that £12k credit card debt looms large – its interest-free period expires in September 2024. I doubt I can clear it by then, especially when I have monthly legal fees ranging from £300 to £800 and the entire responsibility of the family home expenses.

Child support is non-existent and my monthly outgoings are getting insurmountable. At 51, this is the first time I'm dealing with credit card debt and I'm genuinely concerned. I fear being trapped in massive mortgage repayments and losing out on a comfortable life.

I'm eager to understand how others have navigated such challenges. How did you manage? And crucially, which kind of lawyer should I be looking for? What should I expect in terms of legal fees? Any guidance or resource would be invaluable.

Legal Solution

The response provided below is specific to child custody attorneys in the jurisdiction of Florida. If the response is inadequate, please submit a detailed inquiry.

Legal Considerations and Guidance:

Understanding Your Situation:

Your situation is understandably overwhelming, both emotionally and financially. Divorce proceedings can be taxing, and when combined with financial stresses, they can seem insurmountable. However, getting the right legal advice can aid in navigating this tough time.

Relevant Legal Provisions:

For matters like these, you'd typically look into family law provisions. While I cannot provide specific paragraphs, the U.S. Department of Justice's homepage would be a starting point to understand the general legal framework surrounding such issues.

Potential Solutions:

A good first step would be to consult with divorce lawyers who specialize in financial matters. They can offer advice on how to best negotiate with your ex-partner about the division of assets and debts.

Another route to consider, given your financial concerns, is to connect with a financial planner or counselor. They can provide guidance on managing debts, budgeting, and financial planning post-divorce.

Lastly, you might want to explore possibilities of refinancing or consolidating your debt. Given the looming expiration of your interest-free period, this might help in managing repayments.

Fee Structure and Costs:

Legal fees vary greatly depending on the complexity of the case, the lawyer's experience, and geographic location. Here's a rough guide:

Service Average Cost
Initial Consultation $150 - $500
Divorce Proceeding (Uncontested) $1,000 - $3,000
Divorce Proceeding (Contested) $15,000 - $30,000
Financial Counseling Session $100 - $300 per hour

It's essential to understand any fee caps or restrictions in your locality. Many lawyers offer a sliding scale based on income, and others might provide a free initial consultation.

Further Clarification:

To provide you with the best advice, could you offer more details about the nature of your assets, any other debts, and your current income? This will help in tailoring the guidance to your specific situation.

I urge you to seek professional advice. While online platforms offer valuable insights, a personalized consultation can provide you with a strategic action plan tailored to your needs.

Questions for You:

  • What is the total estimated value of the assets you share with your ex-partner?
  • Do you have any other debts besides the credit card and potential mortgage?
  • What is your current monthly income and expenditure breakdown?

Q1: How can I ensure I get a fair division of assets during a divorce?

During a divorce, assets are typically divided based on community property or equitable distribution, depending on the state. Consulting a family lawyer ensures you are aware of your rights and can advocate for a fair distribution.

Q2: Can I renegotiate child support payments?

Yes, child support agreements can be modified based on changes in income, living circumstances, or the needs of the child. You'd need to file a motion in court, and it's advisable to have a lawyer guide you through the process.

Q3: What if I can't afford a lawyer for my divorce?

Many states offer legal aid services for individuals who can't afford private representation. There are also non-profit organizations that provide legal services at reduced rates or even pro bono in some cases.

Q4: Can credit card debt be split during a divorce?

Generally, debt incurred during a marriage is considered joint debt and is divided during a divorce. However, the specifics can vary depending on the state and the circumstances under which the debt was accrued.

Q5: What happens to our family home during the divorce?

The family home can be sold and the profits split, one partner can buy out the other's share, or other arrangements can be made depending on both parties' agreement. The decision often takes into account children, mortgage payments, and other factors.
