My Mother died intestate. Her husband, my step father becomes administrator. My step father then dies intestate 7 years later and his brother becomes administrator of his estate. My step father never began my Mothers probate and started co-mingling funds. My Mothers probate did not begin until after my step father died and her estate was being run through his estate. My Mother had much separate property including IRA's not part of the probate. The administrator of my step fathers estate acted quickly in trying to close out my Mothers estate, absorbing it into his brothers estate and to closing out the IRA's. Before all this took place my step father and his attorney( formally my Mothers attorney) talked me into waiving bond, not fully explaining to me the purpose of having a "bond", I was ignorant in these matters. My step father did not take action on my Mothers probate until after I had him subpoenaed when he passed away. Before he passed we began negotiations where they made me an offer, his attorney offered to pay "my" attorney's fee's if I waived an accounting which I reluctantly agreed to with my attorneys approval. I thought about it after I got home and decided to reject their offer, that's when my step-father died. I began pushing back on their petitions to the court when my attorney encouraged me not to. I fired my attorney for breaching his fiduciary duties to me, he wouldn't do what I wanted him to do and was advocating on their behalf. There is personal and real property involved. I believe there is fraud being committed by my step-fathers attorney. They have yet to honor the court order from 9/9/19 in my pay out. I am stuck and need help.
