My husband and I have been seperated since October 2022. We have properties which consist of 3 lots and which he has been living on (1) of the lot. My husband and I have been making monthly payments to the bank, he pays 1/2 half and I pay half,($175.00 each) total of $350 per month since July 2021. I also co- signed for my husband to get a tractor and he has been making all payment until he was incarceration October 2023. Question is: Since my husband is incarceration and will be for 6 months, now I am responsibility for all debts. He seems to have no worries about these debts especially the tractor payments, but I am still making timely payments. Once I filed for my divorce, how would the property and tractor be handled in my divorce since I am paying for it. What are my options.

Thanks

Analysis of Your Divorce Case

Understanding Your Divorce Situation

Given your circumstances, where your husband is incarcerated and you have joint property and debts, filing for an uncontested divorce might be feasible if both parties agree on the terms. This includes the division of assets (like the properties and the tractor) and debts. However, since you are currently bearing the full financial responsibility, it's crucial to address how these will be handled post-divorce. The division of assets and debts in divorce proceedings can be complex, particularly when one party is unable to contribute due to incarceration.

Relevant Legal Provisions and Resources

Unfortunately, without specific knowledge of the laws in Blakely, it's challenging to list exact statutes or paragraphs. Generally, divorce laws and property division rules can vary significantly by state. It's recommended to visit the official website of your state's government or judiciary for precise legal provisions regarding divorce and property division. If you are in Georgia, for instance, the Georgia Judicial Branch would be a relevant resource.

Possible Solutions for Property and Debt Division

  1. Negotiation and Agreement: You might negotiate a settlement where you're compensated for the additional payments you're making. This could be through a larger share of the property or other assets.

  2. Legal Representation: Consulting with a family lawyer is advisable to explore the best course of action and ensure your interests are protected.

  3. Court Intervention: If an agreement can't be reached, the court will decide on a fair division based on state laws.

  4. Mediation: A mediator could help both parties reach a mutually agreeable solution.

Complexity of Divorce Cases with Incarceration

Divorce cases involving an incarcerated spouse are often more complicated due to:

  1. Communication Barriers: Limited contact with the incarcerated spouse can hinder negotiations.
  2. Financial Strain: The non-incarcerated spouse often bears a greater financial burden.
  3. Asset and Debt Division: Determining a fair division when one party cannot contribute is challenging.

  • Situation: Both parties agree on asset division.
  • Solution: Drafting and signing a settlement agreement with minimal legal intervention.

Case Study 3: Financial Hardship

  • Situation: One party faces financial difficulties due to the other's incarceration.
  • Solution: Seeking temporary orders for support or expedited divorce proceedings.

Key Questions for Further Clarification

  1. Have you discussed the divorce and asset division with your husband?
    • Understanding whether there is initial agreement or contention is important.
  2. Are there any children involved, and if so, what are the considerations for their welfare?
    • Child custody and support are critical aspects in divorce proceedings.
  3. What are your long-term financial goals post-divorce?
    • This helps in strategizing for a settlement that aligns with your future plans.
