I fell and injured my ankle. I was sent to the Emergency room by ambulance. They did an x-ray on my ankle. The doctor asked me about a fracture during that timing but didn’t mention I had fractured my ankle. They said it was a basic sprain and I could return back to work the following day. The dr. wrapped my ankle up in ace bandage and said I needed to see an orthopedic, then sent me home. I couldn't see an orthopedic until it was covered by workman comp. For three weeks I was trying to walk on a fractured ankle not knowing it was injured so bad. I wasn’t getting paid so I had to go into work pain and all the dr said it was fine. The day I went into work I realized my ankle swollen up even more. I talked to my human resource and said I couldn’t work. It was too painful so I went home. I got a call from the dr with my test results from my mri. I had torn ligaments and a fractured foot. She left a message on my phone telling me I need to stay off my ankle completely now and to come back into the office. From there I was in A boot, a cast, and recently a surgery. Can I file a lawsuit against the hospital or doctor?
