I have a breach of contract with a company. The total damages are $22,000.00 their offer is $17,000.00 they do not want to pay for my Attorney’s fees which are $2,227.00 should I take the offer and settle without them paying for my attorneys fees. The law suit stared in 2016. I have 30 days to find another attorney and get a continuance because  the one I had withdrew from the case because he wanted me to settle with out the company paying for my Attorney’s fees and when I said no them he didn’t liked it. I file the law suit in small claims court because I didn’t know at the time that it will be more than 10,000.00 so know if it goes to court it needs to be refile in county court. My ex-attorney told me if I desisted  to take the offer he would help me with the process. Should I settle without the company paying for my attorneys fees. If we go to court the company is demanding from me to pay for their Attorney’s fees if I lose the case, so I don’t understand why they want me to pay for their Attorney’s fees but they are not willing to pay for my Attorney’s fees. What should I do?

Analyzing the Breach of Contract Situation in San Antonio, Texas

Your situation revolves around a breach of contract with damages amounting to $22,000.00 and an offer of $17,000.00 from the opposing party, which excludes your attorney's fees. After a dispute with your previous attorney over the settlement, you are now left with the decision of whether to accept the company's offer or pursue further legal action.

Relevant Statutes and Legal Sources:

  1. Texas Civil Practice and Remedies Code - This code covers matters related to breach of contract and damages.
  2. Texas State Law Library - For a detailed understanding of state-specific legal principles.
  3. Homepage of the Texas Judiciary - An authoritative government website providing information on legal procedures and courts.

Potential Solutions to the Problem

Given the information you provided, there are a few courses of action:

  1. Accept the Settlement Offer: If you choose to accept the $17,000.00 offer, you could potentially save on future legal costs and quickly resolve the matter. However, this would mean absorbing your attorney's fees.

  2. Negotiate a New Settlement: Given that the company is reluctant to pay for your attorney's fees, you could negotiate a middle ground. Perhaps, suggest splitting the fees or seeking a higher settlement amount.

  3. Proceed to Court: Refiling the lawsuit in county court could result in a more favorable outcome, but it's not without risks. If you lose, the company might demand that you pay for their attorney's fees.

  4. Seek New Legal Representation: It's crucial to find the right lawyer who can advise you on the best course of action. Since your previous attorney withdrew, you need someone to effectively represent your interests.
