I placed an ad to adopt my two kittens on rescueme.org and received a reply from a person who was interested in adopting both kittens. I had her sign an adoption agreement stating that she would allow me to visit the kittens with prior notification, which she signed and agreed to verbally as well. However, each time I requested an appointment to see the kittens, she said it wasn't a good time. Finally, she agreed to let me visit them on March 18th, 2017; however, on 3/10/17, she sent me an email message stating that she will not ever allow me to visit the kittens since they belong to her now and will report me to the authorities if I attempt to communicate with her again. She came to my house to take the kittens on 2/20/17 and I gave her all of their belongings, i.e. food, beds, toys, 2 pet carriers, cat tower, Furminator combs, Frontline Plus, cat litter, litter box, food bowls, blankets, towels, etc. She seemed very agreeable at first until she had them in her possession, but then became combative and evasive. I live in Berks county & she resides in Chester county, so I don't know where the lawsuit should be filed.
Small Claims Court can order a Judgment only for money. It cannot require a person to perform a service or to return property, so I would have to sue in a higher court and would need legal representation.
I need an attorney to review my pet adoption agreement and advise if I can sue for the 2 kittens to be returned to me with all of their belongings, which I provided to the adopter, since the adopter breached and reneged on the contract stipulation allowing me to visit the kittens after providing her with prior notification.
