Automobile accident law in Florida in 2023 - key changes
In 2023, Florida is expected to introduce some major changes to its laws relating to automobile accidents. These changes will ensure that victims of auto accidents receive fairer and more equitable compensation for their injuries.
One major change is the elimination of the No-Fault Law
which requires drivers in Florida to carry Personal Injury Protection (PIP) insurance. Under the No-Fault Law, victims of auto accidents could receive compensation from their own insurance company regardless of who was at fault for the accident. However, this can often lead to inadequate compensation and significant disputes over who is actually responsible. With the elimination of the No-Fault Law, victims will now have more options when pursuing compensation.
Another big change
is the introduction of a new statute of limitations for filing lawsuits related to auto accidents. In 2023, victims will have two years from the date of the accident to file their suit against those at fault. This gives victims more time to seek medical attention, consult with attorneys and assert claims for damages suffered during the accident.
In addition, those who are injured in an auto accident due to another driver’s negligence may be able to pursue punitive damages in 2023. This means that a court could award additional compensation if it determines that the defendant acted recklessly or with intent to harm.
