DUI, DWI law in California in 2023 - the most important changes

In 2023, California’s DUI and DWI laws will see some significant changes. One of the most important changes is that the legal Blood Alcohol Content (BAC) limit for drivers 21 and over will be reduced from 0.08% to 0.05%. This change was put in place to more closely align with other states, such as Utah, and to help cut down on the number of drunk driving fatalities.

The penalties for DUI and DWI convictions

will also become more severe in 2023. For first-time offenders, jail time is a real possibility, with sentences ranging from 48 hours up to 6 months depending on the severity of the offense. Fines can range from $390-$1000 if found guilty of a first-time DUI or DWI offense. Repeat offenses will come with even harsher penalties including significant jail time and fines that can reach upwards of $5,000.

Ignition interlock device

Furthermore, California has implemented an ignition interlock device requirement for some drivers convicted of repeat DUI or DWI offenses starting in 2023. This device requires drivers to take and pass a breathalyzer test before they can start their vehicle. This device is then installed in the driver’s car for a period of time, helping to ensure that they remain sober while driving.


In 2023, it will become more important than ever for drivers to be aware of the DUI and DWI laws in California.
