DUI law in West Virginia - 2023 changes

West Virginia has recently passed a new law surrounding DUI offenses that will go into effect in 2023. Under this new law, the penalties for driving under the influence (DUI) have been increased significantly, as well as other related charges such as refusing a chemical test or driving with a suspended license due to a prior DUI conviction.

The new DUI law increases the fines...

for a first offense from $100-$500 to $200 - $1,000 and implements mandatory jail time of at least 48 hours. Additionally, repeat offenders will be subject to harsher penalties. Second convictions within 10 years of the first conviction can lead to minimum jail sentences up to 1 year and fines up to $3,000. Third convictions within 10 years can lead to minimum jail sentences up to 3 years and fines up to $5,000.

The new law also requires those convicted of DUI or related offenses to attend an alcohol counseling program or risk being sentenced to extended jail time. Additionally, all DUI offenders must install an ignition interlock device in their vehicles for a minimum of 6 months and up to 3 years depending on the severity of the offense. The installation of these devices requires specialized training and fees that can add significantly to the cost of a DUI conviction.
